SESSION SUMMARIES

Post Pandemic OSHA

John Polson of Fisher Phillips and Charlie Vance of Current HR will explore how the pandemic has affected OSHA’s enforcement trends. What’s next for OSHA and workplace safety on the other side of COVID-19?  OSHA is gearing up with more investigators.  How will they be used?  What new rulemaking might we see?  When COVID-19 is downgraded from pandemic status, how are employer policies and procedures impacted?  Is mental health the equivalent of a new pandemic?  All these questions and more will be answered in this session.

Payroll Tax Challenges, ERTC, and Opportunities for the PEO Industry

After two years of significant legislative and regulatory activity, payroll tax issues are no longer limited to the finance and payroll departments.  Given the significant business and legal risks, it is more important than ever for PEO counsel and other executives to understand the challenges and opportunities presented by these issues.  From multi-million dollar retroactive ERTC requests to sorting out the mess of deferred Social Security tax repayments, join us for a discussion of the key payroll tax issues that are impacting all PEOs.

Mergers & Acquisitions: The Transactional Side

As the M&A market heats up in the PEO space, it pays to know pitfalls of due diligence.  Fortunately for you, our experts are here to help guide you through the ins and outs of a typical transaction from the legal perspective.  Brian Nugent of Akerman will join Seth Perretta and Malcolm Slee of Groom Law Group to discuss thorny issues they have seen from outside counsel’s perspective on recent transactions.

Case Law Update

William Hays Weissman of Littler Mendelsohn and Steve Pletcher of Scopelits, Garvin, Light, Hansen, & Feary will deliver one of the most highly rated portions of the program:  an update on the key cases and developments in employment law over the past year. This is a can’t-miss session. Consider it an invaluable addition to your legal toolkit.

Ethics: Belligerent Barristers Edition

Come cross the line with Kerim Fidel of Paychex, John Polson of Fisher Phillips, and NAPEO’s own Nick Kapiotis as they explore the ethical limits of being an aggressive attorney.  Using real-life examples of bad behavior, we will take a deep dive into ethics rules about the difference between zealous advocacy and immoral malefaction.

Cross Borders: Is it remotely possible you aren’t in compliance?

The remote workforce is here, whether you like it or not. If the pandemic brought us anything, it has brought us the opportunity to hire employees wherever they are.  In this session, we will cover the effect on the remote workforce on PEO licensing, unemployment taxes, workers’ compensation, wage and hour laws, and other laws.

Data Privacy Laws

The laws have changed and you need to keep up! Learn to assess data security and privacy risks within your organization and your client organizations.  Our experts, Vanessa Wu of Rippling PEO and Usama Kahf of Fisher Phillips, will guide you through the current laws and how you can protect your data and your privacy.

Retirement Litigation Update: Views from the Chamber

The U.S. Chamber of Commerce has ramped up its legal campaign pushing back against the expansion of proposed class actions challenging 401(k) plan fees. The organization filed amicus briefs in a trio of cases in late February and early March urging federal district courts to dismiss claims against companies brought under the Employee Retirement Income Security Act. That followed a similar burst of briefs filed in three ERISA cases at the motion-to-dismiss stage last fall. The Chamber’s expert in this area, Chantel Sheaks, will give an update on this important issue at the forefront of all PEO’s minds.
